Medical waste rules in New Jersey

New Jersey runs one of the most complete tracking programs in the country. The Department of Environmental Protection (NJDEP) administers the Comprehensive Regulated Medical Waste Management Act (N.J.S.A. 13:1E-48.1 et seq.) through N.J.A.C. 7:26-3A, with the Department of Health assisting. Every generator, however small, registers and uses the state tracking form.

  • Registration: all generators except households using home self-care register with NJDEP, pay the fee and obtain an RMW identification number before generating, storing or shipping RMW (N.J.A.C. 7:26-3A.8). Each separate practice in a shared building is its own generator.
  • Seven classes of RMW (N.J.A.C. 7:26-3A.6): cultures and stocks; pathological waste; human blood and blood products; used sharps; animal waste; isolation waste; and unused, discarded sharps.
  • Segregation and packaging (3A.10, 3A.11): separate sharps, fluids over 20 cc and other RMW at the point of generation; containers are rigid, leak-resistant, moisture-impervious, tear-resistant and sealed, puncture-resistant for sharps and break-resistant with a tight lid for fluids.
  • Storage (3A.12): protect packaging from the elements, keep RMW non-putrescent with refrigeration if needed, lock outdoor storage, limit access to authorized staff, dispose immediately if putrescent, and store no longer than one year.
  • Labeling and marking (3A.14, 3A.15): each outer container carries a water-resistant label reading Medical Waste or Infectious Waste or the biohazard symbol, and a tag with the generator's name and address, the transporter's name and NJDEP registration number, and the shipment date.
  • Transport and tracking (3A.16, 3A.19 to 3A.22): use only a transporter registered with NJDEP that holds a Certificate of Public Convenience and Necessity; every shipment travels with the six-copy New Jersey RMW Tracking Form, which the generator signs. If the destination facility's signed copy does not arrive within 35 days the generator follows up, and at 45 days files a Generator Exception Report.
  • Records and reports: keep tracking forms and exception reports for at least three years. Generators of more than 200 pounds in the June 22 to June 21 year file an Annual Generator Report by July 21 (3A.21(d)).
