Oklahoma regulates regulated medical waste (RMW) through the Department of Environmental Quality (DEQ) under Oklahoma Administrative Code 252:515, Subchapter 23, part of the solid waste rules, with the Oklahoma State Department of Health able to add requirements for licensed health facilities. The DEQ rules define the waste and its treatment, permit the processing facilities and incinerators, and draw a small-generator line at 60 pounds a month.

  • Who is covered (OAC 252:515-23-1, -2): every facility that produces regulated medical waste in any quantity, with household waste, hazardous waste (OAC 252:205), diagnostic specimens in transit and remains intended for interment or cremation excluded. The rule points generators to the US DOT packaging rules (49 CFR Part 173) and OSHA 29 CFR 1910.1030 as the federal requirements that apply to handling, packaging, labeling and transport.
  • Small quantity generators (OAC 252:515-23-2): a generator that can document less than 60 pounds of regulated medical waste a month from one location, with records available to the DEQ on request. Its untreated non-sharps waste may go out with municipal solid waste (OAC 252:515-23-3), but untreated sharps may never enter a municipal landfill, dumpster or transfer station in any quantity, from any generator.
  • Sharps (OAC 252:515-23-2, -4): hypodermic needles, Pasteur pipettes, scalpel blades, blood vials, needles with tubing, culture dishes and used slides and cover slips. Untreated sharps are either treated like other RMW or sealed in a rigid, puncture-resistant sharps container filled with a solidifying material, or another method that minimises puncture risk.
  • Treatment (OAC 252:515-23-4): incineration in a DEQ air-permitted medical waste incinerator, steam or microwave sterilisation, chemical disinfection or another method shown to achieve microbial inactivation, defined as a 4 log (99.99%) reduction of the indicator organism. Regulated medical waste is never compacted (OAC 252:515-23-5). Liquids other than chemical or chemotherapy waste may go to a secondary-treatment sewer with the utility's written approval.
  • Commercial facilities (OAC 252:515-23-31 to -35): processing facilities and incinerators hold DEQ permits, keep an approved contingency plan and, once waste arrives, either process it or refrigerate it at 45°F within 24 hours and move it to another permitted site if it is not processed within 96 hours. A hospital or clinic that treats a neighbouring practice's waste as a service rather than for revenue is a shared services facility and follows those operating standards without a DEQ approval.
  • Storage and transport at the generator: the DEQ rule sets no day limit for storage before pickup and does not license medical waste transporters; it defines a commercial transporter and leaves packaging, marking and shipping papers to the US DOT rules it cites. Licensed hospitals and other health facilities may have additional Department of Health requirements.
