Maryland calls it special medical waste and splits it between two agencies. The Maryland Department of Health defines the waste and the acceptable treatment methods in COMAR 10.06.06; the Maryland Department of the Environment (MDE) regulates generators, shipping papers and haulers in COMAR 26.13.11 to 26.13.13. The dividing line is 50 pounds a month.

  • What counts (COMAR 10.06.06.02, 26.13.11.02): liquid or semi-liquid blood and other potentially infectious material, items that would release it if compressed or that carry dried blood capable of flaking off, pathological and microbiological waste, contaminated sharps and anatomical material. Household waste, animal waste without a known zoonotic disease and incinerator ash are excluded (26.13.11.03).
  • The 50-pound line (COMAR 26.13.11.03 B to D): a generator producing less than 50 pounds of special medical waste in a calendar month is excluded from the MDE generator and transporter rules, provided it still makes the waste determination and packages, marks and labels to US DOT standards and treats as required; accumulating more than 50 pounds brings the waste back under the rules. MDE says notification is required at 50 pounds or more in a month or more than 50 pounds on site at any time.
  • Identification numbers and shipping papers (COMAR 26.13.12.03, 26.13.12.04): a regulated generator may not treat, store, transport or offer special medical waste for transport without a Maryland identification number from MDE, may only hand waste to a transporter that also holds one, and prepares a shipping paper to 49 CFR 172.200 to 172.204 for every off-site shipment.
  • Packaging (COMAR 26.13.12.05): before waste leaves, the generator classifies it under the US DOT hazardous materials rules (usually Regulated medical waste, n.o.s. or Infectious substances, affecting humans), packages it to 49 CFR Part 173 and marks and labels it to Part 172. Sharps may not go to a landfill unless incinerated, or sterilised and then mechanically destroyed. Handling on site follows OSHA 29 CFR 1910.1030 (COMAR 10.06.06.03).
  • Treatment (COMAR 10.06.06.04 to .07): autoclaving, chemical disinfection, incineration, disinfection, mechanical destruction after decontamination or an approved alternative; sharps by encapsulation, incineration or mechanical destruction after decontamination. Liquid waste may go to the sanitary sewer where local rules allow.
  • Haulers (COMAR 26.13.13.01): a special medical waste hauler holds an MDE state identification number and a per-vehicle certificate backed by a bond of at least $10,000, an annual fee of up to $50 per vehicle and a safety inspection; vehicles are leakproof, non-compacting and fully enclosed, and a loaded vehicle may not stop for more than 72 hours at a stretch or five days in total. Generators keep annual and exception reports for three years (COMAR 26.13.12.06); the state rules set no day limit for on-site storage.
